PUBLIC HEARING TO CONSIDER AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA, ENACTING ZONING ORDINANCE TEXT AMENDMENT (“ZTA”) NO. 25-02 AMENDING TITLE 19 (ZONING), SECTION 19.31.100(2) OF THE COMMERCE MUNICIPAL CODE (“CMC”) RELATED TO DISTANCE SEPARATION REQUIREMENTS FOR USES PROVIDING ALCOHOL SALES FOR OFF-SITE CONSUMPTION ALONG DESIGNATED COMMERCIAL CORRIDORS AND APPROVING CONDITIONAL USE PERMIT (“CUP”) NO. 25-12 TO ALLOW THE OFF-SALE OF BEER AND WINE (ALCOHOLIC BEVERAGE CONTROL (“ABC”) TYPE 20 LICENSE) AT AN EXISTING ARCO GAS STATION AND AM/PM CONVENIENCE STORE LOCATED AT 6100 E. WASHINGTON BOULEVARD.
Recommendation
It is recommended that the City Council consider:
1. Opening the public hearing and taking testimonial and documentary evidence;
2. After closing the public hearing and considering the submitted evidence:
a. Introduce and waive the first reading of Ordinance No. _____ enacting ZTA No. 25-02 amending CMC Title 19 (Zoning), Section 19.31.100(2) related to distance separation requirements for uses providing alcohol sales for off-site consumption along designated commercial corridors;
b. Adopting Resolution No. 2026-XX approving CUP No. 25-12 to allow the sale of beer and wine for off-site consumption pursuant to ABC Type-20 license at an existing AM/PM convenience store located within an Arco gas station at 6100 E. Washington Boulevard (“Subject Property”), subject to Conditions of Approval, contingent upon approval of ZTA No.25-02 and finding the Project consistent with the CMC, General Plan, and compatible with surrounding uses;
c. Adopting a Categorical Exemption under the provisions of the California Environmental Quality Act (Public Resources Code 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regs. 15000, et seq., the “CEQA Guidelines”) (CEQA Guidelines 15301 and 15061(b)(3)); and
3. Taking such additional, related, action that may be desirable.
