CONDITIONAL USE PERMIT NO. 26-04 - 5807 SMITHWAY STREET (OPERATED BY PAN-AM EXPERIENCE)
Recommendation
It is recommended that the Planning Commission:
1. Conduct the public hearing, take testimonial and documentary evidence, and close the public hearing; and
2. Adopt Planning Commission Resolution No. 26-11 (Attachment A), approving CUP No. 26-04 to allow an Alcoholic Beverage Control (“ABC”) Type-47 On-Sale General - Eating Place license for the sale of beer, wine, and distilled spirits for on-site consumption at an existing bona fide restaurant operated by Pan-Am Experience at 5807 Smithway Street, subject to the City’s Conditions of Approval (Attachment A), and finding that the Project meets all required statutory findings under the CMC; and
3. Determine that adoption of the Resolution is exempt from CEQA pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines.
